In the past people could claim that they 'didn't know' that their hedges were home to a family of blackbirds, or that their roof space had a maternity roost for bats. However, this defence no longer applies. This is because changes to the Wildlife and Natural Environment Bill in Northern Ireland now mean that people can be prosecuted under the charge of 'reckless damage'.
